Terms of Service & Disclaimer (GTC)
#### 1. Nature of the Service, Access Tiers & APK Sideloading
1. Free Test Environment ("As Is"): The platform (web portal and Android application / APK) is provided purely free of charge as an experimental test system on an "as is" and "as available" basis. There is no entitlement to continuous availability, absence of defects, data security, or specific system functionalities.
2. Access Requirements:
The web portal can be accessed by anyone to view publicly published content without registration.
The Android application (APK), as well as actively publishing content, using the watchlist, and direct messaging, require a registered user account.
3. APK Sideloading: Installing the Android application (APK) is carried out as manual sideloading outside of the Google Play Store at the user's own risk. The operator assumes no warranty for operability or compatibility with specific end devices or operating system versions.
4. No Brokerage or Trading Function: The platform functions exclusively as a technical directory and communication medium. The operator is neither an intermediary, broker, or trustee, nor a party to any agreements, contracts, or transactions concluded between users.
#### 2. Registration, Account Security, Self-Deletion & Inactivity
1. Pseudonymous Registration & Local Captcha: Registration requires solely the selection of a nickname and a password. To protect against spam bots, a purely server-side generated captcha is used without integrating external third-party services.
2. Personal Responsibility & No Password Reset: Because the operator deliberately collects no email addresses, telephone numbers, or real names, resetting or recovering passwords is technically impossible. The user bears sole responsibility for securely keeping their login credentials. If the password is lost, account access is permanently forfeited.
3. Two-Factor Authentication (2FA): Users have the option to enable two-factor authentication (2FA) to enhance account security.
4. Self-Deletion ("Danger Zone") & Nickname Quarantine: Users can permanently delete their account at any time via the account settings. To prevent identity theft, confusion, and abuse, the released nickname is locked for a period of 90 days following account deletion and cannot be re-registered by anyone during this timeframe.
5. Inactive Accounts (60-Day Rule): If a user has not successfully logged into the platform for a continuous period of more than sixty (60) days, the operator is entitledβbut not obligedβto irrevocably delete the affected user account, including all stored content, images, and histories, at its own discretion without prior notice. There is no entitlement to reactivation or recovery.
#### 3. Posting Content, Image Processing & Watchlist
1. Mandatory Details & Quotas: Saving content within categories strictly requires specifying a title and at least one image (up to the maximum permitted image count). Descriptions and attribute parameters are optional. The operator may establish upload quotas per account.
2. Visibility: Users can designate content as either public (viewable by all visitors) or private (visible exclusively to their own account).
3. Two-Stage Image Processing: To protect privacy, uploaded images are processed client-side within the browser or app (compression, removal of EXIF and GPS location metadata) and sanitized again server-side and scaled to under 0.5 MB prior to permanent storage.
4. Watchlist: Registered users can save public listings to a personal watchlist (limited quota). The watchlist serves strictly as non-binding bookmarks. If an item or the user account is deleted, the corresponding entry is automatically removed.
5. Warranty of Image Rights & Indemnification: The user expressly warrants that they hold all copyright, trademark, and usage rights to the images and content they upload. Should the operator be held liable by third parties due to an infringement of rights by user content, the user shall fully indemnify and hold the operator harmless from all associated costs and damages.
6. Free Usage License: By posting content, the user grants the operator the free, worldwide, non-exclusive right to technically store, scale, and display the content on the platform within the scope of the chosen visibility setting.
7. Transport Encryption & NO Content Encryption:
Data transmission between the device and server can occur encrypted via HTTPS (TLS). Within the framework of this test environment, however, there is no entitlement to uninterrupted or enforced transport encryption; the user is responsible for ensuring a secure connection.
Content stored on the platform (titles, descriptions, images, direct messages) is not end-to-end encrypted and is stored in plaintext in the database. The data is technically accessible to the system and the operator.
#### 4. Prohibited Content: Confidential & Unlawful Information
1. Strict Prohibition of Confidential Data: It is expressly prohibited to store or transmit sensitive, confidential, or proprietary information on the platform via direct messaging (e.g., passwords, access credentials, trade secrets, financial, bank, or credit card information, official government IDs, health, or intimate personal data). Storing any notes or data occurs at the user's own risk.
2. Strict Prohibition of Unlawful Content: Uploading or transmitting unlawful content is strictly prohibited, including in particular:
Infringements of copyright, trademark, or personal rights;
Pornographic or youth-endangering depictions, particularly depictions of child sexual abuse material (CSAM);
Incitement to criminal offenses, hate speech, seditious, or violence-glorifying content;
Offers of illicit goods (e.g., narcotics, weapons, stolen property);
Doxxing, threats, defamation, or fraudulent activities.
#### 5. No Server-Side Backups, ZIP Content Export & ZIP Import
1. No Server Backups: The operator maintains no automated backups, shadow copies, or recovery services for user data.
2. Local Data Backup (Content Export): Users can export and import their posted catalog content (titles, descriptions, attributes, and uploaded images) at any time via the platform as a ZIP archive. Basic account master data (nickname, profile picture, postal code) are excluded from this content export. Performing regular data backups is the sole responsibility of the user.
#### 6. Direct Messages, Recall, Chat Deletion & Moderation
1. Voluntary Communication & No Duty to Reply: The direct messaging feature is intended for non-binding exchanges. There is no entitlement to the delivery, receipt, acknowledgment, or answering of messages, either between users or against the operator.
2. Messaging Rules & Technical Limits:
Direct messages are limited to a maximum of 100 characters per message.
Recall Function: The sender may irrevocably recall (delete) a sent message for both chat participants within a timeframe of maximum two (2) minutes after sending.
Chat Deletion ("Delete for Me"): Each participant can remove conversations from their own mailbox. This deletes the history in their own view, but does not affect the message history in the other participant's mailbox.
To prevent spam and server overload, message dispatch is subject to strict rate limits.
3. Content Reporting: Users can report unlawful or abusive entries via the reporting function or via direct message to support.
4. Automated 3-Reports Protective Lock: As soon as an item is reported by at least three (3) distinct users, it will be automatically placed on preliminary hold and unpublished. This measure serves precautionary harm prevention (notice-and-takedown). The operator or assigned community moderators review reported content and may re-enable or permanently remove it. There is no legal entitlement to reinstatement.
5. User Blocking: Users can independently block other accounts to prevent messages and interactions.
6. Operator Rights (Categories, Features & Bans): The operator retains unrestricted authority over the structure and functionality of the platform. Categories, features, and translations may be adjusted or removed at any time without prior notice. In the event of breaches of these terms or inactivity, the operator is entitled to terminate profiles and delete content without notice and permanently.
#### 7. WAF Protection & Cooldown Locks
Traffic is monitored via a Web Application Firewall (WAF) and rate-limiting. In the event of suspected Denial-of-Service attacks (DoS/DDoS), message spam, automated scripts, or excessive requests, temporary cooldown blocks will be applied.
#### 8. Limitation of Liability & Governing Law
1. Because this service is provided entirely free of charge and on an experimental basis, the operator's liability for slight negligence, server outages, data loss, software errors, WAF-induced locks, unauthorized third-party access to unencrypted data, or disputes between users is fully excluded.
2. Reserved Operator Rights: Modifying or deleting content, attributes, categories, or profiles (including as a result of inactivity) in the context of system maintenance, moderation, or the exercise of administrative platform rights does not constitute a breach of duty and gives rise to no claims for damages or restoration.
3. Mandatory Statutory Liability: The mandatory statutory liability for intentional immoral infliction of harm, gross negligence, as well as for personal injury (Β§ 879 ABGB - Austrian General Civil Code) remains unaffected.
4. Governing Law & Authoritative Language Version: Substantive Austrian law shall apply, excluding the conflict-of-law provisions of International Private Law (IPL) and the UN Convention on Contracts for the International Sale of Goods (CISG). In the event of any discrepancies between translated versions and the German version, only the German wording shall be legally binding.
